2.3 NRMA Safer Driving School reserves the right to do any of the following:

Purchase of Goods and Services - Terms and Conditions
1. All information about the goods and services on this web site has been provided 'as is'. Although we have endeavoured to provide information which we believe to be correct at the time of entry, we make no representation or warranty that the information on the web site including any descriptions of the goods and services is accurate, complete, reliable, current or error-free.
2. Prices and availability of goods and services are subject to change at any time without notice. Discounted Prices are only for Members of Australian Partner Motoring Associations. The NRMA Safer Driving School reserves the right to correct pricing errors at any time. In the event we discover a pricing error, we will attempt to notify you as soon as possible about the error and, if you decide against the purchase, we will process a refund for the item or items in question.
3. Unless otherwise indicated on this web site, all goods and services available for purchase are priced in Australian Dollars and inclusive of GST.
4. The goods and services offered on this web site are only available to persons who are capable of entering into a legally binding contract with the NRMA Safer Driving School. Without limiting the foregoing, by utilising this web site to place an order, you warrant to the NRMA Safer Driving School that you are 18 or more years of age or otherwise possess legal parental or guardian consent and that you are authorised and able to make payment in the manner selected by you. You also warrant to the NRMA Safer Driving School that all information given by you to the NRMA Safer Driving School through this site (including your name, contact and address details, credit card details) are correct.
5. No contract for the purchase of goods and services will be formed until your order has been accepted by us by sending you a receipt or invoice number. The contract will be deemed to be formed at the time and place where you receive our acceptance. We reserve the right to reject your order for any reason. You warrant that any purchase made by you from us is not for the purpose of commercial resale.
6. Payments can be made with valid credit cards (Visa, MasterCard, via our secure payment gateway or BPAY.
7. Our aim is to hold stock or have immediate access to the goods and services available for sale on-line. However the availability of goods or services may change from time to time as unforseen supply problems or unexpected demand may occasionally result in stock being unavailable. NRMA Safer Driving School is not liable for any loss or damage whatsoever arising from failure to deliver or delay in delivery of any goods or services.
8. All goods purchased from NRMA Safer Driving School's web site are delivered by a freight carrier. The risk of loss and title for the goods pass to you upon our delivery to the carrier. We do not ship to addresses outside Australia.
9. Delivery will occur between 5 and 10 business days after acceptance of an order. These delivery times are a general guide only and NRMA Safer Driving School accepts no responsibility for delays in delivery.
10. Warranty and Liability
10.1 These Terms & Conditions and the Laws of New South Wales, Australia, apply to all transactions for the purchase of goods and services through this web site. No conditions or warranties apply or are given unless expressly set out in the Terms & Conditions. NRMA Safer Driving School does not exclude any rights and remedies available to you in terms of the Trade Practices Act (Cth) or any similar State or Territory legislation in relation to the provision by us of any goods or services via the web site which cannot be excluded, restricted or modified. Otherwise we exclude all conditions and warranties which may be implied by law.
NSW Safer Driving Program - Terms and Conditions
1. General Conditions
1.1 Driving lessons are provided either by NRMA Safer Driving Schools Pty Limited (ACN 122 086 248) of 9 George Street, North Strathfield New South Wales 2137 ('NRMA Safer Driving School') or by its franchisees. Where NRMA Safer Driving School is the provider, these terms govern the agreement between the participant ("you") and NRMA Safer Driving School. Where a franchisee is the provider, that franchisee provides the lessons in its own right and is not an agent of NRMA Safer Driving School, and these terms govern your agreement with the franchisee. NRMA or the franchisee (as the case may be) is referred to as "we", "our" and "us" in these terms and conditions. By booking a driving lesson or lessons as part of NRMA's Safer Driving Program ("Program"), you accept these terms and conditions ("Terms"). *

1.2 These Terms may be varied from time to time and will be updated on the website at www.nrmasaferdriving.com.au. You will be bound by the Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the terms and conditions applicable at the time of booking will apply to each lesson booked at that time.
1.3 By registering with NRMA Safer Driving School, you consent to receive further communications (including electronic communications) from the NRMA Group, including NRMA Safer Driving School, and its franchisees. Your information will be treated in accordance with the NRMA Privacy Policy. This can be found at www.mynrma.com.au.
2. Lesson Bookings
2.1 Lessons must be booked via one of the following channels authorised by us:
a. NRMA Safer Driving Call Centre on 1300 696 762.
b. On-line at www.nrmasaferdriving.com.au
c. At selected local IAG Retail Outlets
d. NRMA Safer Driving School contracted instructor or representative
2.3 Standard lesson bookings can be made up to 12 hours prior to lesson time pending instructor availability. If you make a lesson booking and you do not pay for the lesson at the time of booking, it must be made at least 48 hours in advance of the actual lesson time unless otherwise stated for special promotions or other circumstances.
2.4 Prior to participating in an initial lesson you must provide all the required information to form the student's profile through your preferred booking engine.
2.5 We offer a variety of lesson products, however the accessibility of these products are dependent on the student’s skill level and experience.
3. Payment Conditions
3.1 All bookings must be paid for in full and receipted by NRMA Safer Driving School at least 48 hours prior to the lesson time. If you make a booking within 48 hours of the lesson time, you must make full payment at the time of booking unless otherwise stated for special promotions or other circumstances.
3.2 We accept most major credit cards, Cash & Cheque payments. Payment acceptance varies by booking channel.
3.3 Where your instructor has provisionally booked a lesson on your behalf within 48 hours of the lesson time, you must pay for the lesson in full within 24 hours of the lesson time. If the lesson is within 24 hours of the booking, the lesson must be paid in full via credit card only at the time of booking.
3.4 We reserve the right to offer certain lesson and package types where additional booking and refund restrictions may apply. If any additional booking or refund restrictions do apply, we will notify you at the time any offer is made.
3.5 By booking a lesson, you warrant to us that you are 18 or more years of age or otherwise possess legal parental or guardian consent and that you are authorised and able to make payment in the manner selected by you. You also warrant to us that all information given by you to us through any booking channel (including your name, contact and address details, credit card details) is correct.
4. Virtual Wallet
4.1 Depositing: We provide the facility to make the purchase of items through your online "Wallet". Your wallet is a virtual amount of money retained by us that will allow you to purchase our products at any time through the nominated channels listed in clause 2.1. You may deposit up to a maximum of $1000.00 into your virtual wallet at any one time. These funds will not attract interest. We provide the facility to add money to your wallet via 3 of our nominated booking channels (Website, Call Centre, and Insurance Retail Offices). We accept most major credit cards, BPay, Cash & Cheque payments. Payment acceptance varies by booking channel. Once you have made a deposit into your virtual wallet you will be issued with a receipt number which will only be sent to you upon request. This may be viewed at all times on-line.
4.2 Drawing: Your virtual wallet may only be used by you, or authorised person acting on your behalf, who can answer the 3 point privacy check performed by the NRMA Safer Driving School call centre. These funds may only be used as a form of payment for our products and services and is restricted to you, or an authorised person acting on your behalf.
4.3 Tax Invoice: Only once you have made a purchase from your Wallet will you be issued with an invoice number. A tax invoice can be provided if requested.
4.4 Refunds: Funds deposited by you into your virtual wallet will be refunded at your request through direct deposit into your nominated bank account, less any funds that are non-refundable within the meaning of clause 4.5
4.5 Non-refundable: Non-refundable products and services may include bookings cancelled or rescheduled (with insufficient notice as described in clause 5), special packages or gift vouchers.
5. Fees and cancellations/rescheduled bookings
5.1 You must give more than 3 hours notice to cancel a lesson booking or your lesson fee will be forfeited. If lessons are cancelled by providing more than 3 hours notice full payment is credited to the student's virtual wallet and may be redeemed against another lesson.
5.2 You must give more than 3 hours notice to reschedule a lesson booking. If lessons are rescheduled by providing more than 3 hours notice full payment is transferred and redeemed against the rescheduled lesson. If a booking is rescheduled by providing less than 3 hours notice the lesson fee will be forfeited.
5.3 We reserve the right to reschedule a lesson subject to the provision of reasonable notice. We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle as reasonably determined by us.
5.4 Cancellations outside of call centre operating hours will only be accepted on-line through your customer profile at www.nrmasaferdriving.com.au
6. Promotions, Discounts & Free tuition
6.1 Any discounts or free lesson are not transferrable or redeemable for cash.
6.2 Promotions At times we may run varying promotions and in certain cases additional or different rules may apply. If additional or different rules do apply, we will notify you at the time of the promotion.
7. Gift Vouchers
7.1 Are non-refundable, not redeemable for cash and must be used within 12 months of the issue date. They are not transferrable and cannot be resold. Cancellation and promotional conditions apply.
8. Lessons
8.1 Simulator lessons are held at 9 George Street, North Strathfield only: Our driving simulators have manual transmissions. The duration of a standard simulator lesson is one hour, including lesson briefing and de-briefing.
8.2 On-road lessons commence and end at the pre-determined pick-up point, determined at the time of booking the lesson. The duration of a standard on-road lesson is one hour, including lesson briefing and de-briefing, (excluding the first lesson - see clause 9.2).
9. Provision of Lessons
9.1 You must hold a current NSW/ACT driving licence (Class C LRN or C) or equivalent overseas license and carry it with you at all times during a lesson.
9.2 For both simulator and on-road lessons, the duration of the first standard lesson will be 90 minutes, which includes briefing and/or debriefing time.
9.3 You must not wear high heels, thongs or other footwear which in the opinion of the instructor may cause safety concerns with the foot controls. A flat, enclosed and secure shoe is recommended.
9.4 Mobile phones must be switched off prior to entering the driving simulator or training vehicle.
9.5 For both simulator and on-road lessons, you must be ready to commence the lesson 10 minutes prior to the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may at the instructor's reasonable discretion deduct this from the total lesson time. If you turn up outside these times, your instructor may in his/her reasonable discretion choose not to proceed with the lesson and in such circumstances you will be liable for the cost of the lesson.
9.6 While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time.
9.7 You must comply with the instructions or directions of your instructor at all times, before or during a lesson.
9.8 We reserve the right to terminate a lesson if:
a. you engage in any behaviour that your instructor determines is reckless; or
b. you fail to comply with the instructions or directions of your instructor before or during a lesson; or
c. you fail to comply with any special conditions on your license, i.e. wearing of glasses/contacts; or
d. your instructor has assessed your driving skills and competence and deems you to be unfit or unsafe to drive (see section 11 "Fitness to drive" below).
In the event that a lesson is terminated under the circumstances listed above you will be required to pay the full cost of the terminated lesson.
9.9 If and when you are deemed competent by your instructor, your instructor, may arrange for you to sit your RTA driving test provided full payment for your driving test is received prior to the driving test being booked.
9.10 Your instructor will only present you to the RTA if they deem you competent.
9.11 You will only be presented to the RTA for your licence test once you have booked the correct Licence Test lesson type and provided your test time and registry location.
10. Vehicles
10.1 Use Of Own Vehicle: If you are driving in your own vehicle, your instructor must first assess that your vehicle is roadworthy (only a basic external inspection will be carried out) and the following requirements must be met in relation to your vehicle:
a. the registration label of your vehicle is valid, current, intact and visible.
b. you hold current compulsory third party insurance and comprehensive insurance cover for your vehicle.
c. you have notified your insurance company in writing (prior to your first driving lesson in your vehicle) that your vehicle will be used by an instructor to provide driving lessons.
d. the tyres are correctly inflated (air pressures must reflect the manufacturer's recommendation as a minimum), have appropriate levels of tread and are not damaged.
e. all indicators and brake lights are working.
f. seats and seat belts are in good working order and are not damaged or twisted.
g. any loose items in the cabin of the vehicle are stowed in the cargo (boot) area.
h. the windows and interior are clean.
i. the windscreen is not cracked and shows no signs of damage.
j. the vehicle has sufficient petrol to last the course of the lesson (minimum requirement - a quarter of a tank).
10.2. Instructor Supplied Vehicle: On-road driving lessons are provided in manual or automatic transmission vehicles.
10.3. Instructor supplied vehicles may contain global positioning and monitoring systems with the capacity to identify the location of the vehicle and the manner in which it is operated.
11. Fitness to drive
11.1 In the interests of safety, your instructor may assess your driving skills and competence at any time throughout the course of the Program.
11.2 If necessary, your instructor may refer you to another instructor or to a supervisor for further assessment of your driving skills.
11.3 If at any time you are assessed as unfit or unsafe to drive during a lesson, your instructor may terminate the lesson immediately and may assume control of the vehicle.
11.4 Because the safety of Instructors and Program participants is paramount, Instructors will not enter into any discussions with you regarding an unfit or unsafe driving assessment. If you wish to lodge a complaint about the way in which an assessment was made, please contact the NRMA Safer Driving School Call Centre on 1300 696 762.
12. Limitation of Liability, insurance
12.1 Certain State and Commonwealth legislation, including the Trade Practices Act 1974 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These Terms do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions. Otherwise we exclude all conditions and warranties which may be implied by law.
12.2 To the extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded, is restricted, our option, to:
a. the re-supply of the lessons; or
b. the payment of the cost of having the lessons re-supplied.
12.3 Except for any liability which cannot be excluded by law or that is caused by our negligence, we, our related bodies corporate and our and their officers, employees, franchisees, contractors and agents shall not be liable for any loss, damage or liability whatsoever which is suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained as a result of:
a. you participating in a lesson as part of the Program; or
b. your failure or refusal to follow an instruction or direction of your instructor before or during a lesson; or
c. you being assessed by your instructor as an unfit or unsafe driver; or
d. your instructor terminating a lesson in any of the circumstances set out in clause 9.8 or 11.3; or
e. you continuing to drive after you have been assessed as unfit or unsafe to drive by your instructor; or
f. your vehicle being assessed by your instructor as being unsafe to drive and/or un-roadworthy.
12.4 You indemnify and agree to keep us and our related bodies corporate and our and their officers, employees, contractors, franchisees and agents indemnified against any loss, damage, liability, costs and expenses in connection with your breach of these terms and conditions or any other legal obligation by you.
12.5 Neither we nor our driving instructors accept any liability whatsoever for personal property that is left in any instructor supplied vehicle, driving simulator, your vehicle or on our premises.
12.6 If driving lessons take place in your own vehicle, you warrant that you are covered by compulsory third party insurance and that your vehicle is covered by comprehensive insurance.
12.7 We do not accept any responsibility whatsoever for the outcome of any driving test or assessments you take.
13. Privacy
13.1 NRMA Safer Driving School collects your personal information in order to provide lessons to you and to assess your driving skills and to assist in internal administration and operations including accounting, risk management, record keeping, archiving, systems development and testing, and staff training. NRMA Safer Driving School may use and disclose your personal information to related bodies corporate of the NRMA Group and to its franchisees for these purposes. Franchisees may use and disclose your personal information to NRMA Safer Driving School and its related bodies corporate for these purposes. By booking a lesson you consent to receive further communications (including electronic communications) from the NRMA Group, including NRMA Safer Driving School, and its franchisees in accordance with the NRMA privacy policy at www.mynrma.com.au. NRMA Safer Driving School Gift Card - Terms and Conditions
1. Gift vouchers can be purchased for values of $100, $250 and $500 only (except when promotions or specials are offered). Any unused balance will not be refunded or credited on expiry.
2. Redeemable at locations across NSW and ACT where an NRMA Safer Driving School operates.
3. Lesson prices may vary by region.
4. ACT residents can only purchase gift vouchers via telephone. ACT & Queanbeyan residents must call 1300 696 762 to purchase NRMA Safer Driving School gift vouchers.
5. Gift voucher must be used by 31 December 2012.
6. NRMA discounts do not apply and gift vouchers are not transferable for cash.
7. All session bookings are subject to availability and cancellations can only be made more than 24 hours prior to your lesson. If a lesson is missed or cancelled within 24 hours of your booking, the cost will automatically be deducted from your remaining credit.
8. You should receive your gift voucher within 5 working days, however please be aware the shipping location will affect delivery time, so we recommend you allow up to 10 business days for your order to arrive.
9. In some regions the $100 voucher may not be sufficient to cover the cost of an initial 90 minute session.

NRMA Member Benefit Offer - Terms and Conditions
1. Available to NRMA Members only.
2. The offer will be applied to lessons that are booked and delivered after 1 October 2011.
3. For every 9 (nine) NRMA Safer Driving School hours taken by the same person, that person will be eligible to receive one (1) free hour.
4. An hour becomes eligible to be included in this calculation when payment is received for the lesson in which it was delivered.
5. A valid NRMA Membership number is required at the time of booking.
6.The offer is not available in conjunction with any other offer or discount.
7.The offer is subject to change, however all customers who have purchased lessons after 1 October 2011 and are partially eligible to receive one (1) free hour before the offer is withdrawn, will be provided with a benefit of equal monetary value based on the number of completed hours taken during the offer period.
8. Lessons are non-transferable and non-redeemable for cash.

NRMA Safer Driving School Win A NZ Ski Trip For Four Terms and Conditions
General 1. Information on how to enter the NRMA Safer Driving School ‘WIN A NZ Ski Trip For Four’ promotion (Promotion) and competition prizes described below form the conditions of entry. 2. This Promotion is only available to people who are booking their initial learner driving lesson (First Lesson) with NRMA Safer Driving School. It excludes Keys2Drive and senior refresher lessons. 3. By participating in this Promotion, you will be deemed to have: (a) accepted these terms and conditions; and (b) expressly consented to our use of your personal information for the purpose of the Privacy Act, Spam Act, and other related privacy legislation, for marketing of NRMA Safer Driving School and other NRMA business purposes. 4. The promoter is National Roads and Motorists Association Limited, trading as NRMA Motoring & Services ABN 77 000 010 506 of 9A York St, Sydney, NSW 2000 (Promoter). 5. The Promotion commences at 9am (AEST) on 1 May 2012 and entries close at 5pm (AEST) on 31 July 2012 (Promotional Period). 6. Entry is open to NSW and ACT residents only who are 16 years and over.
How to Enter 7. To enter this Promotion, you must book, pay and take your First Lesson with NRMA Safer Driving School during the Promotional Period. The First Lesson will entitle you to:
a) two entries into the prize draw if you are currently an NRMA Member. Please note that the First Lesson booking must be made using a current NRMA Membership number.
Or;
b) one entry into the prize draw if you are not currently an NRMA Member.
8. The First Lesson can be booked and paid for by phone on 1300 696 762. NSW residents can book online at nrmasaferdriving.com.au. ACT and Queanbeyan residents can book online at nrma.drivingschoolservices.com.au 9. At the time of booking, you must provide your name, residential address, email address, telephone number and any other information so requested. 10. This is a game of chance and skill plays no part. The Promoter’s decision is final and no correspondence will be entered into with entrants.11. All entries, once submitted, become the property of the Promoter.
Eligibility 12. Employees of the Promoter and the Promoter’s group of entities and such employees’ immediate family members are not eligible to enter. 13. To protect the integrity of the competition the Promoter reserves the right, at its sole discretion, to verify at any time (including after the closing of the Promotion) the validity of all entries (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits invalid, incomplete, indecipherable or illegible entries, or tampers with the entry process, or uses any automated entry software or any other mechanical or electronic means that allows repeated illegal entry.
Draws and Prizes 14. All draws will take place at Salmat Interactive Level 1, 116 Miller Street, North Sydney NSW 2060 between 4.00pm and 4.30pm on 15 August 2012. 15. The first valid entry drawn from the total number of entries received, will win:
a) four return economy class airfares from Sydney to Queenstown (including applicable air taxes) to the maximum value of $2,200
b) five nights’ accommodation at Rydges Lakeland Resort, Queenstown in an Economy Backfacing Room
c) three day ski pass for four
d) three day skibus transfers for four
e) return airport transfers for four from Queenstown International Airport to Rydges Lakeland Resort, Queenstown.
16. The winner will be notified by the email address provided on their entry on 17 August 2012 and their name will be published at www.nrmasaferdriving.com.au on 24 August 2012. The winner will also be published in The Canberra Times on 24 August 2012. Only winners will receive written notification of the results of the Promotion. If the winner cannot be reached by 27 August 2012 at the email address, address or telephone number provided on their entry, they will unfortunately be disqualified and their prize made eligible for redraw. 17. If for any reason a winner does not take an element of a prize by the time stipulated by the Promoters, or chooses not to participate in the Promotion, then that prize, or element thereof, will be forfeited. 18. The draw for any unclaimed prizes will take place at 4.00pm (AEST) on 28 August 2012 at Salmat Interactive Level 1, 116 Miller Street, North Sydney NSW 2060 subject to any directions from a regulatory authority, and subsequent winner/s will receive an email and have their name published on www.nrmasaferdriving.com.au on 3 September 2012. 19. Prize is for four people (the winner, plus three nominated companions one of whom must be an adult if the winner is aged under 18 years) quad-share. It is valid for departure between 1 September 2012 until 7 October 2012. Bookings must be made at least 7 days in advance of the departure date. Prize is subject to availability at time of booking and must be booked by 10 September 2012. Blackout periods may apply. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the winner’s cost. 20. The total prize pool value is $4,472. 21. The Prize value is correct at time of printing and the Promoter accepts no responsibility for any subsequent variation in the prize value. 22. The Prize does not include allowances or spending money, nor does it include any other ancillary costs such as out-of-pocket costs and expenses for meals, beverages, insurances, passports, visas, ski or snowboard equipment hire or excess baggage. 23. 25. If any prize (or part of any prize) is unavailable, the Promoter reserves the right to substitute the prize (or part of the prize) with a prize of equal value or specification, subject to any written directions given by the appropriate State or Territory Lottery Departments. No responsibility or liability is accepted for any variation in the value of the prizes. All prize values are in Australian dollars.
26. Prizes are not exchangeable, transferable or redeemable for cash. They are non-commissionable and cannot be extended past 7 October, 2012. 27. In a force majeure event (including war, terrorism, state of emergency, disaster, civil disorder, strikes, riots, quarantines, embargoes or other similar government action, computer virus, technical failures, any other malfunction or corruption of a computer system or network required to administer prizes) or any other circumstances beyond the control of the Promoters, the Promoters reserve the right to either provide an alternative travel destination to the same value as the original prize or, subject to any applicable laws or written directions made under application legislation, to cancel, terminate, modify or suspend the Promotion. 28. The winner agrees that any liability they may suffer as a result of receiving goods or services that make up part or all of the prize, is a separate liability that is between them and the relevant supplier only. The Promoter may, for an indefinite period, unless otherwise advised, use your personal information (such as name, age, membership number and image, mobile phone number, email address) and any other information provided to the Promoter pursuant to this Promotion without remuneration or compensation to you for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you, regarding NRMA Safer Driving School and businesses within the NRMA Group.Limitation of Liability 32. The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the Promotion. To the extent permitted by law, the Promoter is not liable for any loss (including indirect and consequential loss) suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again. 33. Subject to the approval of the relevant State and Territory Lottery Departments, the Promoter may:
a) modify or suspend the Promotion if all entrants participating in the competition until that point are notified of the changes to these Conditions of Entry, upon notification of any such changes, the affected entrants may terminate their participation in the competition without any liability to the entrant; or
b) terminate or cancel the Promotion.
The Promoter will not be liable for any modification, suspension, termination or cancellation.
